NailSoft Gift Card Terms and Conditions

EFFECTIVE 2019

This NailSoft Gift Card Agreement (“Agreement”) is between you and NailSoft and describes the terms and conditions that apply to your NailSoft Gift Card. By buying or using your NailSoft Gift Card, you agree to these terms.

We issue the NailSoft Gift Card to you. It allows you to use it to discount an amount of money on your NailSoft App. The dollar value that you presented on your NailSoft Gift Card is a prepayment for the goods and services of participating stores. We offer the NailSoft Gift Card to make it easier for you to shop with us and to make your relationship with us more rewarding. Unless otherwise required by law or permitted by this Agreement, the dollar value on your NailSoft Gift Card is nonrefundable and may not be redeemed for cash. The value on your NailSoft Gift Card is not insured by the Federal Deposit Insurance Corporation (FDIC), nor does it earn interest.

Without any further conditions from other promotions held by NailSoft or participating merchants, NailSoft Gift Cards shall be accepted by all merchants on NailSoft App. These Gift Card cannot be used with any other sale or promotion unless there is a further notice.

The NailSoft eGift Card (also known as an “eGift”) program allows you to purchase and send a virtual NailSoft Gift Card via email, or via certain social media and messaging platforms. You may choose the value (within certain limits) and complete your purchase using a credit card, debit card, or certain other electronic payment methods.

Note:

  • An eGift is like any other NailSoft Gift Card and should be treated like cash by the recipient.
  • Each eGift has a unique NailSoft Gift Card number associated with it, no matter how many times it was used, we only accept the first time that code is used.
  • The Gift Card will not be replaced in case lost or stolen.

Value on Your Card:

  • NailSoft Gift Card will have different values (20, 50 or 100 USD) and was presented on the card.
  • The value of NailSoft Gift Card could not be loaded or transferred from account to account.
  • The total value of the NailSoft Gift Card is to be used. Balance from each of the Gift Card (20, 50 or 100 USD), if any, will not be returned in cash or move to the next transaction.
  • This Gift Card is non-refundable and cannot be exchanged for cash in part or full and is valid for a single transaction only.

In the United States, you can buy a gift card at retail stores or online. With an online gift card, the card will be activated immediately. With Gift Card from a retail store, merchants shall activate it before handing over to you.

There are unique requirements and restrictions on the use of NailSoft Gift Cards by businesses such as the prohibitions against reselling NailSoft Cards and using NailSoft Gift Cards to solicit new customers. The detail for B2B will be discussed separately.

From time to time, we may in our sole discretion, run promotional programs associated with the NailSoft Gift Card. Such Promotions are subject to these terms, as well as additional terms as indicated in connection with the Promotions. We reserve the right to modify the terms and conditions of any Promotion at any time, including and up to terminating the Promotion.

We do not charge any activation, service, dormancy or inactivity fees in connection with your NailSoft Gift Card. Your NailSoft Gift Card has no expiration date nor does the value on your NailSoft Gift Card ever expire.

We will not accept any NailSoft Gift Card code if we reasonably believe that the use is unauthorized, fraudulent or otherwise unlawful, and we consider such action appropriate to limit our risk. NailSoft does not control who may sell NailSoft Gift Cards, nor can we control the price offered by independent sellers. Consequently, NailSoft Gift Card has no liability to you for any third-party fraud or unlawful activity associated with any NailSoft Gift Card value. If NailSoft discovers any NailSoft Gift Card was sourced or derived from fraud or other unlawful means, we may in our sole discretion, cancel all impacted NailSoft Gift Cards and retain all related NailSoft Gift Card without notice to you.

We may amend this Agreement at any time. We will post the amended Agreement to our website. As permitted by applicable law, any change, addition or deletion will become effective at the time we post the revised Agreement to our website. Unless we state otherwise, the change, addition, or deletion will apply to your future and existing NailSoft Gift Cards.

We may suspend or terminate this Agreement and revoke or limit any or all of the rights and privileges granted to you at any time without notice or liability. Termination may result from your fraudulent or unauthorized use of the NailSoft Gift Card including your failure to provide valid information.

NailSoft and its affiliates make no representations, warranties or conditions of any kind, express or implied, with respect to the NailSoft Gift Card, including, but not limited to, any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement, or any warranty arising by usage of trade, course of dealing or course of performance. NailSoft does not represent or warrant that your NailSoft Gift Cards will always be accessible or accepted.

We may assign all or part of this Agreement without notice to you. We are then released from all liability. You may not assign this Agreement without our prior written consent and any attempted assignment will be void.

This Agreement is the complete and exclusive statement of the agreement between you and NailSoft and supersedes and merges all prior proposals and all other agreements governing your NailSoft Gift Card (not including NailSoft Privacy Policy, the NailSoft Terms of Use, as applicable).
